NEPA Clamps Down On Phil's Incoporated

The Natural Resources and Conservation Authority/National Environment and Planning Agency (NRCA/NEPA) is taking legal action against Phil's Incorporated for not complying with Stop and Enforcement notices served on the company under the NRCA and Town and Country Planning Authority Acts.

The notices were served on February 26 as a result of the company engaging in construction works without planning permission at 3 Central Avenue in Kingston.

The company is also undertaking unauthorized dumping at the site, resulting in the blockage of the natural drainage system. As a result, the area is impassable when it rains, creating a public nuisance.

During heavy rainfall, schools in close proximity, including the Queens High School, are severely affected as Central Avenue is impassable, forcing students to use alternative routes to access the school.

As such, the Agency is seeking a court injunction to cease all construction at the site. In addition to court proceedings, NEPA will be working with the National Works Agency to restore the site to its original state and prevent future flooding of the area.
